Public Hearing Set on Fair and Affordable Housing

SCARSDALE, N.Y. – A public hearing on amendments to the Village Code to include a new article titled "Fair and Affordable Housing is on the agenda for the Tuesday's Board of Trustees meeting at Village Hall.

The amendments are necessary to bring Scarsdale into compliance with federal and state regulations regarding affordable housing. "I don't expect it to be a problem," Mayor Miriam Levitt-Flisser said recently. "What we have to do is all spelled out in the legislation."

Section 1 of the new local law reads: "Pursuant to New York State Constitution Article IX, Municipal Home Rule Law §10 and a municipality's police powers to protect the health, safety and welfare of residents thereunder, the Board of Trustees of the Village of Scarsdale hereby determines that the integration of fair and affordable housing is beneficial to the health, safety and welfare of its residents. The purpose of this law is to protect the public health, safety and welfare by mandating within all residential developments of ten or more units created by subdivision or site plan approval, that ten percent of the total number of units be created as fair and affordable units, as defined by this chapter; and in multi-family residential developments of five to nine units, no less than one of those units shall be a fair and affordable unit, as defined by this chapter."

Also Tuesday night, Flisser is expected to discuss the Town and Village Civic Club Education Forum-Planning and Zoning Committee's 2010 Report on Construction Project Approval Activities.

In addition, the agenda includes: A resolution regarding scheduling a Public Hearing to Amend Chapter 310 of the Village Code to Clarify the Prohibition of Interior Lots, and a resolution regarding adoption of An All-Hazard Mitigation Plan

Following the Trustees meeting, the Municipal Services Committee will meet in the Trustees Room to discuss the Foreign Fire Insurance Tax Village Makeup Appropriation. The Board of Trustees meeting is scheduled to begin at 8 p.m.
