Scarsdale Police Make Marijuana Possession Arrests

SCARSDALE, N.Y. – Three Scarsdale residents were arrested last week after a homeowner observed them smoking marijuana and drinking alcohol on Valley Road.

According to police, Jonathan Fermo, 30, Michael Fermo, 23 and Connor O’Leary, 22, were arrested late on Thursday, Dec. 5, and released in the early hours of Friday morning after a brief police search found them in the parking lot of the Greenacres School field on Montrose Road.

At approximately 10 p.m., police received a tip from a Valley Road resident who “observed a red Audi, occupied by three or four males” who were “smoking what appeared to be marijuana cigarettes.” The caller also noted that a passenger was drinking a beer contained in a brown paper bag.

After a brief search, police found the car in the school parking lot. According to Officer David Rosa, who was the first on scene, O’Leary was drinking a Budweiser when he approached them.

“While I was speaking with them, I observed a plastic Tupperware container containing bags of marijuana, a pipe with marijuana residue and rolling papers in plain view of the front passenger side floor area of the vehicle,” he said. “All three of the males had watery, bloodshot eyes, slurred speech and were slightly unsteady on their feet.”

Both Jonathan and Michael Fermo refused to make a formal statement on the matter, but the latter insisted he was the driver of the vehicle and he had no idea where the drugs came from, according to Rosa’s report.

O’Leary voluntarily produced a sunglasses case that contained rolling papers, a green metal pipe containing marijuana residue and a plastic container which contained marijuana, according to Officer Timothy Beherman, who assisted at the scene.

The three were arrested on a charge of unlawful possession of marijuana, a violation, and released on their own recognizance. Each is due back in court on Wednesday in Scarsdale Village Court.
