Suspect Busted In Scarsdale DWI With Suspended License, Police Say

SCARSDALE, N.Y. - A Bronx man is facing multiple misdemeanor charges in Scarsdale after being busted driving while under the influence with a license that had recently been repeatedly suspended.

At approximately 6:30 a.m. on Saturday morning, 23-year-old John Daniel Rodriguez was stopped by officers near the intersection of Feinmore and Donellan Road in Scarsdale, police said.

According to police, when asked to step out of his vehicle, “it was apparent that Rodriguez was unsteady on his feet, had glassy eyes and there was an odor of alcoholic beverage on his breath.” Officers reported that Rodriguez stated he “had two or three beers” at Don Coqui in White Plains, but had stopped drinking because he was the designated driver.

Rodriguez failed several standardized field sobriety tests, including a Horizontal Gaze Nystagmus, walk-and-turn and one-leg-stand test. At the completion of the tests, police said that Rodriguez stated that he felt he would fail an also-sensor breath test, “no matter how much he had to drink.” When he eventually relented, his blood alcohol content was .10.

Police arrested Rodriguez and charged him with misdemeanor charges of driving while intoxicated, operating a motor vehicle with a blood alcohol content greater than .08 percent and aggravated unlicensed operation of a vehicle for having three or more suspensions in three months.

Rodriguez was released on his own recognizance and is due back in village court on Wednesday, Feb. 15.
